    Strange but True Tales of 403(b) Plans

    403(b) plans really are different. The little noticed minutiae of the 403(b) rules are often the ones which trigger the most difficult circumstances to resolve.  Two well-traveled 403(b) aficionados will light-heartedly detail a number of the most regularly occurring quirks that hamper effective plan administration and create unexpected issues, and they will explore potential solutions.

    • Explore key, technical differences between 403(b) plans and 401(k) plans
    • Identify unusual document drafting issues for which sponsors should be aware
    • Identify unresolved regulatory issues and filing issues.

    Evan Giller, JD, Boutwell Fay, LLP

    Evan Giller has worked in the field of employee benefits law and ERISA for over 25 years, specializing in the retirement and deferred compensation plans of tax-exempt organizations and governmental employers. He has extensive experience advising employers and plan service providers on a wide range of retirement plan issues, including plan design, plan documents, operational issues, corrections and fiduciary responsibility, and has particular expertise regarding 403(b) and 457 plans. In addition, Evan’s practice includes advising financial institutions on issues relating to the design and regulation of annuity products, in particular annuities used to fund retirement plans.

    Robert Toth, JD, Toth Law and Consulting 

    Robert has practiced employee benefits law since 1983. His practice focuses on the design, administration and distribution of financial products and services for retirement plans, one which combines elements of ERISA, tax law, insurance law, securities law and investment law for both 401(a) and 403(b) plans. Bob’s experience includes the design of multiple employer plans; implementing 403(b) programs under the new regulations; designing investment products for 401(k) plans; annuitization programs for defined contribution plans; advising on prohibited transactions issues related to retirement plan products and services and their distribution, development of open architecture programs for 403(b) plans and writing and implementing standards for fiduciary and advisory practices.

    Planning for Retirement Health Care Costs

    One of the biggest fears employees have about retirement is not being able to afford quality health care - yet many fail to integrate health care planning into a holistic retirement savings strategy.  There are several reasons people delay or overlook planning for health care expenses in retirement.  The thought of gradually - or rapidly declining health can be an unpleasant and emotionally draining exercise.  Also, there is a common misperception that Medicare will cover more health care expenses than it does, as well as an evolving and increasingly complex health care system that makes it difficult to predict what future costs may be.

    In addition, health care expenses are the biggest line item in an employer's benefits budget - and they are the most valued benefit to employees.  With 75% of plan sponsors linking Health Savings Accounts to a retirement savings strategy, it's not if advisors will find themselves in health care conversations, it's when.

    This program provides:

    • An overview of the health care landscape - including health care costs, and an understanding of the predictable health care costs in retirement.
    • A review of savings strategies - pretax, Roth, and HSAs to help employees prepare financially, with a detailed perspective on the features and benefits of HSAs.
